Terms & Conditions

General Terms

​

  1. Ensure all details on the application form are correct. Pitch confirmation and other correspondence will be sent via email. Please check your spam for emails from us.

  2. All Traders must have Public Liability Insurance (with a minimum £5m indemnity limit) a copy of which must be supplied before the event. We maintain the right to recover costs from you in respect of any claims brought against us for which you may be responsible.

  3. Insurance is the responsibility of the individual trader who are expected to ensure they are covered for all eventualities. We accept no liability for loss or damage to traders produce, during set up & close or during the event.

  4. We and any persons associated with us, shall not be responsible for any loss or damage to merchandise or personal property, nor for any injury caused by the activities of the event, the weather or any other reason or cause.

  5. In the event of severe weather, including strong winds and snow we will monitor the situation and determine whether the event can go ahead.

  6. In the situation that the event cannot take place due to weather conditions or other situations outside of our control, where there is a danger to the traders, the public, our staff, or property, we will contact the traders at the earliest opportunity.

  7. Traders MUST inform us if they are unable to attend for any reason.

  8. Traders are responsible for complying with all statutory requirements including but not limited to Food Safety & Hygiene regulations, Food Labelling regulations, Weights & Measures Act, Licensing Act and the Consumer Protection Act or any amended or re-enactment from time to time in force.

  9. No trader shall sell any item that contravenes any of the following, or similar associated legislation: Trade Descriptions Act 1968, Video Recordings Act 1984, Copyright Designs & Patents Act 1998 and the Trademarks Act 1994.

  10. Traders may only sell the product lines and good that they have detailed in their application. Any proposed changes or additions must be confirmed in advance of the event. Failure may result in us asking you to stop selling certain items.

  11. Please ensure your displays are adequately stocked with saleable goods.

  12. Traders May NOT sub-let any part of their pitch.

  13. No single use plastic or polystyrene to be used to serve food or drink.

  14. In agreeing the terms and conditions, traders shall indemnify the Organisers and all event staff from and against actions, costs, losses (including legal fees), claims or demands in respect of any accident, damage, death or injury to any person or property arising directly or indirectly from the traders’ use of the stall.

  15. We have the right to amend these terms and conditions at our discretion. If a change is made a new set of terms and conditions will be sent to all confirmed traders.

  16. We reserve the right to increase future pitch fees. However any pitch fee's that are prepaid will be honoured.

 

 

Payments

  1. On confirmation of your application please pay the agreed amount via BACs (details will be in

  2. the confirmation email)

  3. Payments must be received no later than 1 month before the event, unless otherwise agreed.

  4. Your pitch will not be allocated or fully confirmed until payment has been received.

  5. If you cancel within 30 days of the start of the event you will forfeit your fee for the full cost of your pitch.

  6. There will be no refund of fees in the event of adverse weather on the day or should the event be cancelled entirely. Traders are advised to consider their own cancellation insurance if required.

Arrival, Departure, Set-up & Close down

​

  1. Set up information and arrival times will be confirmed no later than 3 days before the event.

  2. If you miss your entry time slot, we reserve the right to move your pitch or refuse entry to the event entirely. No refunds will be given in this circumstance.

  3. We reserve the right to relocate any trader temporarily or permanently, either with or without prior notice or immediately, in the event of an emergency or special circumstance.

  4. Vehicles are not permitted to be parked behind stalls. Parking is not provided but there are multiple local carparks nearby.

  5. All traders must be ready to trade for 10am, please let us know if you require a particularly long amount of time to set up.

  6. Traders must not start to pack down until the market ends at 3pm.

  7. Vehicle access to Courtenay Street will not be permitted after 9.45am. All vehicles must be clear of the street by 10am and cannot come back until after the market ends at 3pm.

  8. All traders must have removed their entire product and belongings from the market area by no later than 5pm.

  9. All traders agree to remove their waste from their pitch area at the end of the day. Any waste remaining on your pitch that requires disposal will be charged a disposal fee of £5 per black bag.

  10. No trade waste is to be placed in the public bins.

  11. All traders are responsible for maintaining the cleanliness of their gazebo/trailer whilst trading at the events.

  12. All traders are responsible for maintaining the cleanliness of the road/paving surface within their trading area. Any damage to the ground from oil spills etc that requires professional cleaning to be contracted will be charged a cleaning fee of £100 minimum.

  13. We will remove any part of the traders’ stall & display that is outside their allocated trading space. 

  14. Music or sound amplification equipment is not permitted for use on trade stands.

 

 

Equipment & Power

​

  1. No goods or structures may be placed outside the limits of the pitch space that you are allocated.

  2. All traders’ gazebos must be of high quality and suitably weighted. A gazebo risk assessment will be required to be completed in advance of the event.

  3. Electrical availability is limited. Please let us know if you need power in your application.

  4. All electrical items used at the market MUST have a current PAT Test Certificate, which we will require in advance of the event. Failure to provide this will result in a request to remove the item and in exceptional circumstances, confiscation.

  5. All electrical equipment brought to the event must comply with the current IEE regulations and the Electricity at Work Regulations 1989. We strongly recommend that stallholders seek professional advice covering all electrical equipment they bring to any events.

  6. Trailing cables are not allowed in public areas.

  7. Traders must use the power provided as generators are not allowed to be used.

  8. Gas appliances may only be used with prior consent and upon receipt of a valid gas safety certificate. Failure to provide this will result in a request to remove the item and in exceptional circumstances, confiscation.

  9. Spare LPG cylinders, both full and empty, shall be enclosed with barriers and stored away from public areas and removed at the end of the show. Stallholders leaving cylinders on site will be charged a minimum of £200 for their removal.

  10. You will be required to provide a completed fire risk assessment if using cooking appliances.

  11. All Caterers are required to provide fire-fighting appliances of a sufficient number, of a type suitable for the possible purpose, and which have been checked annually and fully maintained.

Personal Data

​

  1. We reserve the right to share details of the stallholders with sponsors of the events.

  2. We reserve the right to film and take photographs of the events for promotional purposes only.

  3. Your personal data will be handled in accordance with the EU General Data Protection Regulation (GDPR) and in line with our privacy policy.

  4. Your Name, Email, Business Name, Phone Number and any other contact details will be stored electronically to enable us to contact you in respect of the event operations.

  5. We will retain your information for a period of one year from your final event with us at which time it will be deleted from our system.

  6. To help promote your business and support the events, we will disclose your name/business name, stall location and the nature of the products you sell. No other contact details will be disclosed without your express permission.

  7. Your personal information will not be disclosed to anybody outside of organisation without your permission unless there is a lawful basis to do so.

  8. Information on your application form may be passed, upon request, to third parties such as the Devon & Cornwall Police, the CPS, Department of Social Security, HMRC, the Immigration Department, Devon County Council Trading Standards and other relevant official bodies.
